Return of goods

CANCELLATION OF THE CONTRACT, RETURN OF GOODS, EXCHANGE

1. Goods purchased in the e-store are sold, returned and (or) exchanged in accordance with Articles 6.2285-6.22811, 6.334, 6.362-6.363 of the Civil Code, as well as the Retail Trade Rules approved by the Government of the Republic of Lithuania of 11 June 2001 by Resolution No. 697 (with subsequent amendments and supplements).

2. The Buyer has the right, without giving a reason and without incurring any costs other than those established in Article 6.22811 of the Civil Code, to withdraw from the concluded Contract within 14 (fourteen) calendar days, except for the exceptions provided for in Article 6.22810 of the Civil Code. 2. For the sake of clarity, it is noted that the aforementioned exceptions include, among others, Contracts for Goods manufactured according to the Buyer’s special instructions, which are not pre-manufactured and which are manufactured taking into account the Buyer’s personal choice or instruction, or for Goods that are clearly adapted to the Buyer’s personal needs. In other words, if the Goods sold to the Buyer are manufactured according to the Buyer’s special order, the Buyer’s right to withdraw from the Contract specified in this clause does not apply to the Buyer.

3. In order to return the Goods, the Buyer must notify the Seller thereof within 14 (fourteen) calendar days from the date of delivery of the Goods to him by e-mail info@linoksa.lt. The Buyer may deliver the Goods himself (at his own expense) to the Seller’s office during the working hours of the Seller’s office, published in the E-shop.

4. § 12.2–12.3 of the Rules The right provided for in this Article may be exercised only by the Buyer, who is to be recognized as a Consumer (clause 1.8).

5. When returning high-quality Goods, the following conditions shall be met:

5.1. The Buyer's notification to the Seller about the return of the Goods shall be submitted within the time limits set for the return of the Goods;

5.2. The Goods must be in their original, neat packaging

5.3. The Goods must be undamaged;

5.4. The Goods must be unused (untested), not having lost their commercial appearance (undamaged labels, untearable protective films, etc.);

5.5. The Goods must be in the same configuration as the Buyer received them;

5.6. When returning the Goods, it is necessary to provide the invoice for their purchase and indicate: the Buyer's name and surname, bank account number (if the money for the Goods is returned by transfer), invoice number and reason for the return;

5.7. The costs of purchasing and returning the Goods shall be borne by the Buyer;

6. If the Buyer has purchased a set of Goods assembled by the Seller as a single Product, he must return the entire set of goods to the Seller, i.e. the Buyer shall have the rights provided for the return of Goods only in respect of all Goods in the set. In the event that at least one of the conditions specified in clauses ‎12.5.1–‎12.5.5 is not met by the Buyer in order to return the Goods, the Seller shall have the right to refuse to accept the entire set of Goods returned.

7. The Seller shall have the right to refuse to accept the Goods returned by the Buyer if the conditions for returning the Goods were not met.

8. If the Buyer has exercised the right established in clauses ‎12.2–‎12.3 of the Rules, the money shall be returned to him (in cash or by transfer to the bank account specified by the Buyer) within 15 (fifteen) business days after the Seller has received the Goods returned by the Buyer.

9. The Seller has the right not to refund the amounts paid by the Buyer until the Goods have been returned to the Seller and checked for compliance with clauses ‎12.5.2–‎12.5.5 of the Rules.

10. If a price difference arises when exchanging the Goods, the Buyer must settle with the Seller based on the recalculated prices.

QUALITY GUARANTEE PERIOD OF GOODS, RETURN, EXCHANGE OF DEFECTIVE GOODS

1. When purchasing Goods for Consumers (clause 1.8), the Seller provides a 24 (twenty-four) month warranty period for the Goods sold and ensures the proper functioning of the Goods during the warranty period. In the case of other Buyers, the Seller provides a 6 (six) month warranty period, unless another term is specified in the Product description.

2. The warranty applies under the following conditions:

2.1. the returned Product must be in the same configuration as the Buyer received it;

2.2. the returned Product must be clean;

2.3. the warranty period for the returned Product must not have expired.

3. The warranty does not apply in the following cases:

3.1. Failure to provide documents for the purchase of the Product.

3.2. If the Product is operated for purposes other than its intended purpose or in violation of the requirements specified in these Rules and (or) the Product instructions;

3.3. Due to mechanical damage caused by the Buyer during the operation of the Product after purchase (damage caused by impact, fall or other mechanical impact);

3.4. If the Product is damaged due to factors beyond the Seller's control.

4. When returning a poor-quality or incomplete Product, the Buyer must indicate (provide):

4.1. Order number of the Product;

4.2. When returning the Product remotely: A photo of the Product and packaging, taking a photo of the defects of the Product or packaging;

5. Description of the defects or signs of failure;

6. Request: (i) replacement of the poor-quality or incomplete Product with a high-quality product; or (ii) supplementing the incomplete Product with missing components; or (iii) refund the money paid.

7. When returning defective Goods, the costs of returning the Goods shall be borne by the Seller, compensating for the delivery (shipping) fee normally applied in the E-store. If no defects are found in the Goods, shipping costs shall not be reimbursed.

8. The same quality guarantee period as was established for the Goods purchased by the Buyer shall apply to the Goods or their parts replaced during the warranty period.

9. When returning or exchanging Goods purchased in the E-store, the Seller has the right to require the completion of the provided Goods return or exchange form.
